These Terms of Service ("Terms") govern your use of PokémonSniper.com and related services (the "Service") provided by PokémonSniper.com ("PokémonSniper," "we," "us," or "our"). When we present these Terms for affirmative acceptance during account creation, purchase, or another clearly identified flow, your acceptance creates this agreement. Merely visiting a public page does not by itself mean you agree. If you do not agree when acceptance is requested, do not create an account, purchase, or continue with that flow.

Service and eligibility

PokémonSniper provides tools that can help organize card-collection information, research cards, create watches, and generate AI-assisted responses. Features may change, be experimental, or be unavailable. You must be at least 18 years old, provide accurate account information, keep your credentials secure, and use the Service only if you can form a binding agreement where you live.

AI, prices, and third-party information

Card prices, guide values, sale references, and marketplace information are estimates or reference information only. They are not an appraisal, offer, authentication result, investment recommendation, or guarantee of value, profit, savings, availability, alert delivery, or alert timing. A card's grade, edition, language, condition, authenticity, completeness, market venue, seller reliability, and other facts can materially change its value. Recent sales may be incomplete or mismatched, and may exclude fees, shipping, taxes, returns, or other costs unless expressly shown.

Independently verify the exact card and grade, current listing terms, price, condition, authenticity, fees, taxes, shipping, and all other material details before you buy, sell, list, bid, ship, insure, or take another action. PokémonSniper does not endorse or independently verify information from xAI (Grok), PriceCharting, eBay, or any other third party. Their products, listings, and policies are their own.

PokémonSniper is independent and is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Nintendo, Creatures Inc., GAME FREAK inc., PSA, eBay, PriceCharting, or xAI. Pokémon and other third-party names and marks belong to their respective owners.

Your responsibilities and delegated actions

You are responsible for the instructions, permissions, limits, account connections, and information you provide to the Service. Review every recommendation, draft, price, configuration, and proposed action before you approve or act on it. You are responsible for decisions involving transactions, listings, bids, pricing, payments, shipping, insurance, and communications with other people.

When you use AI assistance, you acknowledge that AI mistakes, market losses, and unauthorized or incorrect actions are possible, and voluntarily assume the risks of relying on outputs and of actions you instruct or authorize, to the maximum extent permitted by law. You must maintain oversight and verify proposed actions. An AI response or proposed action is not confirmation that any external action occurred.

Some future features may allow you to authorize automated actions within limits you choose. If you enable such a feature, you must revoke permissions you no longer want. We do not represent that every type of action is available. Each actual authorization remains required; these Terms do not authorize unlimited actions. You are responsible for obtaining any permissions you need to provide information or connect an account. Nothing here shifts liability that cannot lawfully be waived or limited.

Acceptable use

You may not misuse the Service, including by violating law or third-party rights; using it for fraud, deception, unauthorized access, harassment, or harmful activity; interfering with security or service operation; scraping or extracting Service data except as allowed by law; bypassing limits; introducing malware; or submitting content or instructions that you do not have the right to provide. You may not use the Service to impersonate another person or make a decision that unlawfully discriminates against someone.

Your content

You keep ownership of the content you submit. You give us a limited, non-exclusive right to host, process, reproduce, and transmit it only as needed to operate, secure, and support the Service. You represent that you have the necessary rights to provide that content and instructions.

Paid features

If you purchase a paid feature, the price, billing interval, renewal terms, cancellation method, and any applicable refund terms will be shown to you before purchase. You authorize the disclosed charge when you complete the purchase. You may cancel a recurring paid feature at any time using the method made available in your account or checkout materials, or by emailing ash@pokemonsniper.com; cancellation prevents future renewal and, if the paid plan is active, access continues through the paid period. Cancellation and deletion are separate requests; tell support if you want both so we can stop future renewals and handle your data request together. Except where required by law, we do not refund consumed usage. These Terms do not limit any cancellation, refund, or other rights that cannot lawfully be waived.

Third-party services

The Service may link to or work with third-party services. Your use of a third-party service is governed by that provider's terms and privacy practices. We are not responsible for third-party services, listings, transactions, content, availability, or policies.

Suspension and termination

We may suspend or end access when reasonably necessary to protect the Service, users, or others; comply with law; or address a material violation of these Terms. You may stop using the Service at any time. Sections that by their nature should continue after termination will continue.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION. We do not disclaim warranties or obligations that cannot lawfully be disclaimed.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PokémonSniper and its officers, directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to the Service. Our aggregate liability for all claims arising from or related to the Service will not exceed the total fees you actually paid us for the Service. This limit does not include amounts paid to third parties for cards, marketplace transactions, shipping, taxes, insurance, or other outside costs.

These limitations do not exclude liability that cannot lawfully be limited or excluded, including as applicable liability for fraud, willful misconduct, gross negligence, or non-waivable consumer-protection obligations.

Individual claims and severability

To the extent permitted by law, claims relating to the Service must be brought only in an individual capacity and not as a plaintiff or class member in a class, collective, consolidated, representative, or private-attorney-general action. This provision does not limit your right to bring an individual claim in small-claims court where available, to report a matter to a regulator, or to seek public injunctive relief where that right cannot lawfully be waived. If any part of this provision is unenforceable, that part will be severed and the remaining Terms will remain in effect to the extent permitted by law.

Indemnity

To the extent permitted by law, you will defend and indemnify PokémonSniper from third-party claims, damages, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, or content or instructions you provide without the required rights. This obligation does not apply to the extent a claim results from our own unlawful conduct or from obligations that cannot lawfully be shifted to you.

Governing law and courts

Florida law governs these Terms, without regard to conflict-of-law rules. Subject to any non-waivable consumer-protection or jurisdiction rights, the state and federal courts located in Miami-Dade County, Florida have exclusive jurisdiction over disputes arising from these Terms or the Service.

Changes and contact

We may update these Terms as the Service changes. We will post the updated Terms here and revise the effective date. The exact text of this version is archived at /legal/2026-09-17.1/terms.html.
